To better serve you, please read theMyPic User Agreement ("This Agreement"). /b16>Before you begin to use MyPic software and related services, be sure to read and fully understand this Agreement, in particular the terms that exempt or limit liability, the license and use of information, the applicability of the law, and dispute resolution terms. Among them, important content such as exemption or limitation of liability clauses will prompt you to pay attention in bold form, and you should focus on reading. If you are under the age of 18, please read and fully understand this Agreement, accompanied by your legal guardian, and download the Software with the consent of your legal guardian.
Do not download, install, use (collectively, "use") myPic software, or usemyPic services in any way, or obtain any services provided by MyPic software (collectively, "use" in this Agreement) unless you fully accept the entire contents of this Agreement. If you use MyPic software and related services, you are deemed to have fully understood this Agreement and undertake to be bound by it as a party to this Agreement.
1. Scope of application
1.1 This Agreement is an agreement between you and this MemePick Group(the "Company")regarding your download, installation, use of the MyPic Software and the acquisition of the Services provided by the MyPic Software. Certain services covered under this Agreement may be provided to you by the Company's affiliates and control companies, and you know and agree to accept the content of such services, i.e. you are bound by this Agreement as if you accept the relevant rights and obligations between the parties.
1.2 "User" means all users, including natural persons, legal persons and other organizations, who directly or indirectly acquire and use MyPic software and related services. In this agreement, it is referred to as "user" or "you".
1.3 MyPic refers to a client application legally owned and operated by the Company, labeled MyPic, which provides users with innovative and easy photo services.
1.4 The contents of this Agreement also include agreements, rules, etc. that the Company has published and may continue to publish regarding MyPic software and related services. Once the foregoing is officially published and delivered to the user (system notice, etc.) in an appropriate manner, it is an integral part of this Agreement and you shall comply with it as well.
2. Use MyPic software and related services
2.1 You use MyPic software and related services to obtain MyPic client applications through pre-installed, company-licensed third-party downloads, etc. If you do not obtain the Software from the Company or a third party authorized by the Company, the Company cannot guarantee that the unofficial version of MyPic Software will be used properly and your loss as a result shall not be related to the Company.
2.2 The Company may have developed different versions of application software for different end devices, and you should obtain, download, and install appropriate versions based on the actual condition of the device.
2.3 You may use myPic software and related services or update versions of MyPic as you wish, if you no longer need to use MyPic software and related services and uninstall them yourself.
2.4 In order to improve the user experience and services, the Company will provide software updates or changes from time to time (including, but not limited to, software modifications, upgrades, enhancements, development of new services, software replacements, etc.). In order to ensure the security of MyPic software and related services, improve the user's services, the software and related services updates or some service content updates, where possible, the Company will include, but is not limited to, system prompts, announcements, in-site letters and other means to prompt users, users have the right to choose to accept updated versions or services, if not accepted by users, some features will be restricted or can not continue to use.
2.5 Unless authorized in writing by the Company in advance, you may not have unauthorized access to or use of MyPic Software and related services in any form, including, but not limited to, adaptation, reproduction, dissemination, vertical search, mirroring or transactions.
2.6 You understand that your use of MyPic software and related services requires that you prepare your own terminal equipment (e.g. mobile phones, etc.) related to the Software and related services, and that once you open myPic software in its end device, you will be deemed to be using MyPic Software and related services. To fully implement the full functionality of MyPic, you may need to network your end device, and you understand that you are responsible for the costs (e.g. traffic, Internet, etc.).
2.7 The Company licenses your personal, non-transferable, non-exclusive and non-commercial legal use of MyPic software and related services. All other rights not expressly authorized by this Agreement remain reserved by the Company and you are required to obtain written permission from the Company in the exercise of such rights, and the Failure of the Company to exercise any of the foregoing rights does not constitute a waiver of that right.
3. User Code of Conduct
3.1 User behavior requirements
You are responsible for your use of this product and related services, unless permitted by law or with the prior written permission of the Company, your use of MyPic software and related services may not:
3.1.1 Use any plug-in, external, system, or third-party tool without the Company's authorization or license to interfere with, disrupt, modify, or otherwise influence the normal operation of MyPic software and related services.
3.1.2 Use or engage in any act against the network security of your computer, including but not limited to:
(1) illegally break into other people's networks, interfere with the normal functions of other people's networks, steal network data and other activities that endanger network security;
(2) To provide programs and tools specifically designed to engage in network intrusion, interference with the normal functions and protective measures of the network, theft of network data and other harmful network security activities;
(3) Knowing that others are engaged in activities that endanger network security, provide them with technical support, advertising promotion, payment settlement and other assistance;
(4) use unauthorized data or access unauthorized servers / accounts;
(5) unauthorized access to public computer networks or other people's computer systems and delete, modify or increase the storage of information;
(6) unauthorized attempts to detect, scan, test weaknesses in myPic systems or networks or other acts that undermine network security;
(7) attempts to interfere with or disrupt the normal operation of myPic systems or websites, intentionally spread malicious programs or viruses, and other acts that interfere with normal network information services;
(8)Forge the TCP/IP packet name or part of the name.
3.1.3 Reverse engineering, reverse assembly, compilation, or other attempts to discover the source code of myPic software.
3.1.4 Violations of laws and regulations, this Agreement, the Company's relevant rules and other acts that infringe upon the legitimate rights and interests of others.
If we find or receive reports or complaints from others that users violate the terms of this Agreement, we reserve the right to review and delete the contents of the reports and complaints at any time without notice, including, but not limited to, user profiles, chat history, and to impose penalties including but not limited to warnings, account closures, device bans, functional bans, and notify users of the results of processing, depending on the seriousness of the circumstances.
3.1.5 Users who have been blocked for violating this Agreement may file a complaint with the MyPic team's e-mail(support@memepick.com). We will review the complaint and make a reasonable decision as to whether to change the penalty.
3.2 Users using MyPic software and related services shall consciously abide by constitutional laws, regulations, public order, social morality, socialist system, national interests, the legitimate rights and interests of citizens, morals and information authenticity. Users may not use MyPic software and related services to create, reproduce, publish, and disseminate information that:
(1) opposing the basic principles established by the Constitution ;
(2) endangering national security and disclosing state secrets;
(3) subverting state power, overthrowing the socialist system, inciting secession and undermining national unity;
(4) harming the honor and interests of the State;
(5) promoting terrorism and extremism ;
(6) to promote national hatred, ethnic discrimination and undermine national unity;
(7) inciting geographical discrimination and regional hatred;
(8) to undermine the state's religious policy and promote cults and superstitions;
(9) fabricating or spreading rumors and false information to disturb the economic and social order and undermine social stability ;
(10) spreading or disseminating violence, obscenity, pornography, gambling, murder, terror or instigating a crime;
(11) infringing upon the legitimate rights and interests of minors or harming the physical and mental health of minors ;
(12) stealing or recording others without their permission, infringing upon the legitimate rights of others;
(13) contains contents of terror, violence, blood, high risk, harm to the physical and mental health of the performer himself or others;
(14) endangering network security and using the network to engage in endangering national security, honor and interests;
(15) insulting or slandering others and infringing upon their legitimate rights and interests;
(16) violent intimidation and threats against others and the conduct of human flesh searches ;
(17) involving the privacy, personal information or information of others;
(18) spreading foul language, harming the public order of society;
(19) infringing on the legitimate rights and interests of others such as privacy, reputation, portrait, intellectual property rights, etc
(20) spreading commercial advertisements, or similar commercial solicitations, over-marketing messages and spam;
(21) comments in languages other than those commonly used on this website;
(22) Other informationthat violates laws and regulations, policies, and public order, interferes with MyPic's normal operations, or infringes the legitimate rights and interests of other users or third parties.
3.3 The company set up a public complaints, reporting platform, users can in accordance with the company's public complaints reporting system to the MyPic team(support@memepick.com)mailbox complaints, report all kinds of illegal violations, illegal dissemination activities, illegal and harmful information and other content, we will promptly accept and handle user complaints and reports, in order to jointly create a clean network space.
4,personal information protection
4.1 We work with you to protect your personal information, which is one of the company's basic principles. use of 20> During MyPic's process, you may need to provide your personal information so that we can provide you with better service and appropriate technical support. /b20> You understand and agree that the Company reserves the right to obtain, use,store and share your personal information in compliance with laws and regulations, this Agreement, andthe MyPic Privacy Policy.
4.2 The Company will use technical measures such as encryption, anonymization and other security measures to protect your personal information from misuse or unauthorized access, use or disclosure of your information, and to establish a sound management system for the purposes described above.
4.3 In the course of your use, we undertake not to collect or use important information such as your various bank cards, third-party payment accounts and corresponding passwords without your express authorization. You understand and agree that you are solely responsible for the disclosure of such material information for your own reasons and any loss that may result therefrom.
4.4 We will not share your personal information with any third party other than the Company and its affiliates without your express prior authorization, except in the following cases:
(1) You share it with a third party yourself;
(2) directly related to national security, national defense security, public safety, public health and public interests;
(3) Disclosure or provision in accordance with the requirements of applicable laws and regulations, mandatory administrative and judicial requirements, or directly related to criminal investigation, prosecution, trial and enforcement of sentences. (4) To the extent permitted by laws and regulations, to safeguard the vital legitimate rights and interests of other MyPic users, companies and their affiliates, or to facilitate the safe and stable operation of MyPic software and related services, such as finding, preventing, handling illegal activities such as fraud and reducing credit risk (excluding the disclosure or provision of personal information for profit in violation of commitments made in MyPic'sPrivacy Policy);
(5) Collecting personal information from information that is legally publicly disclosed, such as legitimate news reports, government information disclosure and other channels;
(6) Other circumstances as prescribed by laws and regulations.
4.5 If Mypic contains information or other services (including websites) linked to third parties, you know and understand that third parties operating such services may require you to provide such personal information. ry. /b20>This Agreement (and other agreements and rules relating to Mypic, including, but not limited to, myPic'sPrivacyPolicy) does not apply to services provided by any third party and the Company is not liable for any consequences arising from the use of personal information provided by you by third parties.

5. MyPic Data Usage Specification
Users may not, on their own or without the written permission of the Company, authorize, permit, or assist any third party to perform the following actions on the content of information in this Agreement's MyPic software and related services:
5.1 Copy, read, and use the information content of myPic software and related services for commercial purposes including, but not limited to, publicity, increased reading, and browsing;
5.2 Unauthorized editing, collation, and organization of the information content of MyPic software and related services to be displayed in channels other than the source pages of MyPic software and related services;
5.3 Use any form of identification method, including, but not limited to, special logos, special codes, etc., to generate traffic, reading guidance, transfer, hijacking, etc. by third parties on their own or in assisting third parties in generating traffic, reading guidance, transfer, hijacking, etc. of information or content of MyPic software and related services;
5.4 Other illegal access to the content of information about MyPic software and related services.
6. Breach of contract
6.1 The Company reserves the right to independently determine and take action as appropriate in the case of your violation of this Agreement or other Terms of Service. The relevant records will be kept for suspected violations of laws and regulations and suspected illegal crimes, and the relevant competent departments shall be reported to and cooperate with the relevant competent departments in investigation in accordance with the law.
6.2 If you cause a third party to file a complaint or claim for action in violation of this Agreement or other Terms of Service, you shall bear all legal liability. If the Company and its affiliates or control companies compensate any third party or are subject to penalties imposed by state organs as a result of your violation or breach of contract, you shall also pay full compensation to the Company and its affiliates and control companies for all losses suffered as a result.
6.3 The Company respects and protects the legitimate rights and interests of legal persons and citizens in such areas as intellectual property rights, reputation rights, name rights and privacy rights. You warrant that the use of MyPic software and related services to produce, reproduce, publish, disseminate information does not infringe on the intellectual property rights, reputation rights, name rights, privacy rights and other rights and interests of any third party. You shall bear full legal liability for all claims made by third parties, and if the Company and its affiliates or control companies (including economic, goodwill, etc.) suffer losses as a result of your infringement, you shall also pay full compensation to the Company and its affiliates and control companies for all losses suffered.
7. Changes, interruptions and terminations of services
7.1 You understand and agree that the MyPic software and related services provided by the Company are provided in accordance with the status quo as available and conditions are available. The company will do its best to provide you with services to ensure consistency and security of the services. You understand that the Company cannot anticipate and guard against technical and other risks at any time, including, but not limited to, force majeure, viruses, Trojan horses, hacking attacks, system instability, third-party service defects, and other security issues that may result in service interruptions, data loss, and other losses and risks.
7.2 You understand and agree that the Company reserves the right to modify, discontinue, discontinue or terminate the MyPic Software and related services after notice of notice without liability or liability to the User.
8. Advertising
8.1 In the course of your use of MyPic software and related services, you fully understand and agree that the Services may include information, advertising or branding services (including commercial or non-commercial information) that the Company may provide to individuals or businesses, and that the Company reserves the right to display commercial advertisements, promotions / or information (including commercial or non-commercial information) about MyPic software and related services and related services in myPic software and related services.

8.3 The Company performs its advertising and promotional obligations in accordance with the law, and you shall determine for yourself the authenticity and reliability of the advertising or promotional information and be responsible for your own judgment. Except as expressly provided by laws and regulations, the user shall bear the responsibility and the Company shall not be liable for any damage or loss you have suffered as a result of the purchase, transaction or loss of the advertising or promotional information.
Intellectual property rights
9.1 The Intellectual Property Rights Of The Content ProvideD By The Company In MyPic Software And Related ServiceS (Including, But Not Limited To, Software, Technology, ProgramS, Web PageS, Text, ImageS, ImageS, Audio, Video, GraphicS, Layout Design, Electronic Documents, Etc.) Are Owned By The Company. The copyright, patent and other intellectual property rights of the software on which the Company provides this service are owned by the Company. No one may use it without the Company's permission (including, but not limited to, monitoring, copying, disseminating, displaying, mirroring, uploading, downloading content from MyPic software and related services through any program or device such as robots, spiders, etc.).
9.2 The Company provides technical support for the development and operation of MyPic and has full rights to all data and information generated during the development and operation of MyPic software and related services.
9.3 Please do not use any trademarks, service marks, trade names, domain names, website names or other significant brand features of the Company (including, but not limited to, MyPic, etc.) in any circumstances (collectively, "Identity"). You may not display, use or apply for a registered trademark, register a domain name, etc. in any way, individually or in combination with the company's prior written consent, nor may you express or imply to others that you have the right to display, use, or otherwise have the right to process such marks. You are solely liable for any damages you may incur to the Company or others as a result of your use of the Company's trademarks, logos, etc. in violation of this Agreement.
10. Disclaimer
10.1 You understand and agree thatMyPic software and related services may be affected or interfered with by a number of factors and that the Company does not warrant (including but not limited to): ) (
10.1.1 The company is fully suitable for the user's use requirements;
10.1.2 The Company is undisturbed, timely, safe, reliable or error-free, and any software, services or other materials obtained by the Company meet the user's expectations;
10.1.3 Any errors in the software will be corrected.
10.2 Users understand and agree that in the course of using MyPic Software and related services, they may encounter factors such as force majeure (force majeure means objective events that cannot be foreseen, overcome or avoided), including, but not limited to, government actions, natural disasters, network causes, hacking attacks, wars, or any other such event. In the event of force majeure, the Company will endeavour to repair it in a timely manner in the first place, but the user agrees that the Company shall not be liable for the loss caused to the user by force majeure.
10.3 The Company acquires the right to deal with illegal and illegal content in accordance with the provisions of this Agreement, which does not constitute an obligation or commitment of the Company, and the Company cannot guarantee the timely discovery or appropriate treatment of the violation.
10.4 Users read, understand and agree that the Company does not provide any kind of express or implied warranty or condition, including, but not limited to, commercial suitability, suitability for specific purposes, etc., regarding the Services of this Agreement. Your use of this Agreement software and related services is at your own risk.
10.5 Users read, understand and agree that this Agreement is to ensure compliance with national laws and regulations, safeguard public order and customs, protect the legitimate rights and interests of others, the Company within its capabilities to make the best efforts in accordance with the relevant laws and regulations to judge, but does not guarantee that the Company's judgment is fully consistent with the judgment of the judiciary, administrative organs, such as the consequences of the user has understood and agreed to bear.
11. Terms of use for minors
11.1 If the user is a minor under the age of 18, he or she shall read this Agreement and use the MyPic Software and related services with guardianship, guidance and consent from the guardian.
11.2 The Company attaches great importance to the protection of the personal information of minors, and when filling in personal information, minor users should strengthen their awareness of personal protection and be cautious, please use MyPic software and related services correctly under the guidance of their guardians.
11.3 Minor Users understand that if you violate laws and regulations and the contents of this Agreement, you and your guardian shall bear all consequences as a result of this in accordance with the law.
11.4 Special tips for minor users:
11.4.1 Teenagers using the Software and related services should, under the supervision of their guardians, properly learn to use the Network within a reasonable range, avoid indulging in virtual cyberspace, and develop good Internet habits.
11.4.2 Young users must comply with the National Convention on the Civilization of youth networks:

Others
12.1 The laws of each region shall apply to the establishment, entry into force, performance, interpretation and dispute resolution of this Agreement. If any provision of this Agreement is invalid as a result of a conflict with the laws of each region, these terms will be as close as possible to the original provisions of this Agreement and the other provisions of this Agreement shall remain in full force and effect.
12.2 The relevant terms of this Agreement will be continuously refined and continuously improved and adjusted during software testing and external release. Once these refined terms have been formally issued, they shall be an integral part of this Agreement and shall have the same legal effect as this Agreement. 12.3 The title in this Agreement is for convenience and reading only and does not affect the meaning or interpretation of any provision of this Agreement.
12.4 You and the Company are independent entities and under no circumstances does this Agreement constitute any form of express or implied warranty or condition of the Company to the User, nor does it constitute an agency, partnership, joint venture or employment relationship between the parties.
12.5 The copyright of this Agreement is owned by the Company and the Company reserves the right to interpret and modify it in any way.
